General Terms & conditions
Please read carefully the following Terms & Conditions. These Terms define your and Equal Yoga rights and obligations. Equal Yoga may from time to time amend these Terms. The most recent version of these Terms can be accessed at any time at https://equalyoga.com/content/terms-and-conditions .
1. INTERPRETATION & VARIATION
1.1
In the Terms & Conditions, the following definitions apply:
Company means Equal Yoga Holding BV (trading as Equal Yoga Amsterdam Linnaeusstraat BV, Equal Yoga Amsterdam Rozengracht BV, Equal Yoga Amsterdam Studio BV, Equal Yoga Utrecht Oudegracht BV, Equal Yoga Utrecht Kaatstraat BV and Equal Yoga Academy BV) Member/Studio User means any person that has signed a Registration Form or ticked the Waiver box online which the Company has accepted. Registration Form means the registration & application form signed by each Member. Studio means any of the Yoga Studios of the Company as published on our website(s). Terms & Conditions as defined here.
Website means www.equalyoga.com or affiliated websites.
1.2
The Terms & Conditions are incorporated into the Registration Form & online booking system.
1.3
The Company reserves the right to vary or revoke any of the Terms & Conditions from time to time which it may consider necessary or suitable for the regulation of the governance of the Studio and the conduct of Members. Any such changes will be published on our websites and, until revoked, are binding on Members.
1.4
The Terms & Conditions shall be governed by the laws of The Netherlands & subject to the exclusive jurisdiction of the Dutch courts.
2. MEMBERSHIP/STUDIO USER
2.1
Subject to condition 2.2, when a person has signed a Registration Form or ticked the terms & conditions online they shall become a Member of the Studio or a studio user. This includes visitors of aggregators (like Onefit or ClassPass).
2.2
Acceptance of a person as a Member or a studio user is at the discretion of the Company.
2.3
The Company reserves the right to withdraw, suspend or refuse to renew the membership of any Member or User whose conduct is, or may deemed to be in the Company’s reasonable opinion, injurious to the character of the Studio or amounts to a breach of the Terms & Conditions or where such expulsion is otherwise to be in the interests of the other Members of the Studio. Any Member so expelled shall forfeit all privileges to membership & shall not be entitled to any refund for any period during which his membership is suspended.
2.4
The Studio may run promotional introductory offers from time to time. These offers are exclusively for new students who are not already registered (Members/Users) with the Studio & are not for repeat use.
3. STUDIO OPENING TIMES
Details of class times at the Studio may vary from time to time. The Studio will publish class times on our Website. Studios are open 15 minutes before and after class.
4. PAYMENT TERMS
4.1
Details of class prices & class card prices are available on our website(s) or shall be such prices as determined by the Company from time to time.
4.2
Payments for classes at the Studio do not entitle you to attend classes at any other yoga Studio other than those operated by this Company (if they are available).
4.3
Subject to any statutory right of cancellation, payments for classes, class card fees, monthly subscription fees & annual payments are made non-refundable unless otherwise stated in the Terms & Conditions.
4.4
Retreats, workshops, and other programs at Equal are non-refundable. They can be credited to the account if notice is given a minimum of 10 days before the program date due to unforeseen circumstances (exceptions made for certain medical/personal circumstances at The Company’s discretion). Deposits however are non-refundable.
4.5
Refund policy for workshops. Cancel 31 days or more prior to the start of the training: refund of 100% of the workshop fee. Cancel 30-15 days prior to the start of the training: refund 50% of the workshop fee. Cancel 1-14 days prior to the start of the training: no refunds.
5. MONTHLY AUTOPAY
5.1
The provisions of clause 5 shall only apply to Members who subscribe to classes monthly (Subscription).
5.2
Members shall be given no less than 30 days written notice of any increase in their Subscription (unless otherwise agreed in their contract)
5.3
A Member may cancel their Subscription as per their contract type by written request to info@equalyoga.com, giving a 10-day notice before the next renewal date.
5.4
Members agree & acknowledge that by agreeing to the Minimum Subscription of the contract chosen, they are being given preferential rates by the Company & therefore it is fair & reasonable that the Company charges them for any payments as described & referred to above.
5.5
If the payment is not successful, we have the right to cancel the membership and charge for any additional administration costs. Any issues or concerns with monthly payments should be sent to info@equalyoga.com.
5.6
With Auto top-up, the company will immediately renew the contract after a member reaches 0 classes regardless of the next renewal date. The new activation and renewal date will then be based on the day that the Auto top-up happened.
Customers must have a credit card on file for Auto top-up to work successfully because the company will charge them for the next payment. If a customer does not have a credit card on file, or the card is declined, the Contract will be reported under Failed Billing and the class count will not replenish.
5.7
Unused monthly classes will not carry forward to the next monthly contract.
5.8
Members who do not wish to accept a change proposed by the Company to the Terms & Conditions or to pay an increase in any Subscription fees may cancel their Subscription by giving written notice to the Studio. The notice must be given before or within 30 days after the change to the Terms & Conditions or increase in subscription fees takes effect & must expire at the end of the relevant calendar month. The Member giving notice must continue to pay subscriptions at the rate current immediately before any proposed increase until the end of such notice period.
5.9
If a customer's auto-debit payment fails, the company will try to take the payment up to 3 times. If the third attempt to take payment is still unsuccessful, the contract will be ended immediately.
5.10
At Equal, memberships are flexible and we have several options to suit everyone. Memberships can be frozen for a maximum of 2 times per year for a minimum of 2 weeks and a maximum of 4 weeks in total. Just send a request to our support team support@equalyoga.com
6. PERSONAL BELONGINGS
Personal belongings are brought into the Studio premises at the Member’s risk & the Company does not accept liability for any loss or damage whatsoever to such items. For security reasons, Members are advised to place personal belongings in the lockers provided & not leave them in the changing rooms/bathroom area.
7. FACILITY BOOKINGS
7.1
Cancellations – If you cancel more than 2 hours before the start of class no fee is applied. This allows waitlist students to be contacted & join the class.
7.2
Late Cancels – If you cancel within 2 hours of the class start time, you will be charged a 5 euro fee and if you have a class pass, you will lose a class.
Please remember that you must go to our online booking system & remove yourself from the class list.
7.3
Our Online Booking Facilities & rules are as follows:
Classes can be booked online up to 2 weeks in advance for Equal members.
Classes can be booked online up to 1 week in advance for external members.
All students with online bookings must sign in at least 5 minutes before the class starts.
When classes have reached their online booking capacity you can add yourself the waitlist.
If you are on the waitlist, up until 2 hours before the class, as soon as a spot becomes available, you will be automatically added to the class and receive a booking confimation email.
If you add yourself to the waitlist less then 2 hours before class, when a spot becomes available, you will receive an email with a booking link and you will need to try and book the class again. This will be on a first-come-first-served basis.
7.4
Off Peak hours:
Amsterdam: Weekdays: 10h00-17h00 | Weekends: After 11h30
Utrecht: Weekdays: till 17h00
8. USE OF FACILITIES
8.1
A Member is entitled to use the Studio’s facilities during scheduled class times providing always that the Studio may at any time withdraw all or part of its facilities for any period or periods & with notice, where practicable, in connection with any leaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or the Company.
8.2
Children under the age of 18 may only use the Studio & attend classes if accompanied by an adult & when under their care & supervision, however the Studio reserves the right of refusal for any minor to practise according to clause 9.1
9. FITNESS & HEALTH
9.1
Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns about their physical condition. The Studio reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.
9.2
Members with the following conditions should not attend class: low/high blood pressure & cardiac irregularities. If there is any doubt, the Member should consult his doctor. Members & their guests must notify the Studio of any circumstances affecting their health which may be exacerbated through continued use of the Studio.
9.3
Members are required to follow the instructions of the teacher at all times.
10. DRESS & FOOTWEAR
Members are requested to wear a form or dress appropriate to the practice of Barre, Pilates and Yoga. Footwear should be removed on entry to the premises & left in the hall area by instructions.
11. SAFETY & HYGIENE
11.1
Smoking is not allowed anywhere on the premises.
11.2
Do not walk around the Studio, changing rooms or showers barefoot (please wear flip-flops) if you have foot complaints. Members must use the appointed entrance to the Studio when entering or leaving the Studio.
11.3
In the event of a fire, Members are asked to make their way to the nearest available exit.
12. GENERAL GUIDELINES
12.1
Members must at all times observe the Studio guidelines which may be notified to them from time to time & are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.
12.2
Members are required to keep their details up to date through the profile on the company’s website. All communications shall be assumed to have been received by the Member within 5 days of mailing to the last address notified to the Company.
12.3
The Company reserves the right to refuse admission to the Studio.
12.4
The Company may, if a Member so wishes, communicate with the Member by email. By providing an email address to the Company the Member consents to receiving email communications from the Company, including notices under the Terms & Conditions. The Member also accepts any risk that email may not be a fully secure & confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.
13. LIMITATION OF LIABILITY
13.1
The Company cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the types of facilities provided, without notice & in its absolute discretion & the Company shall not be liable for any loss occasioned by such alterations except in so far as loss is by law incapable of exclusion.
13.2
It is the Member’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme that they follow or class that they attend. Members accept the risk of injury from performing exercises & are advised to consult their doctor before beginning any programme or class. The Company accepts no liability for loss or damage to property or injury of Members or their guests to them on the Studio premises or outside the Studio except in so far as such loss, damage, or injury is by law incapable of exclusion.
14. WEBSITE TERMS & CONDITIONS
Information published on this website is provided for the use of its visitors & you are advised that, although care has been taken to ensure technical & factual accuracy, some errors may occur. No guarantee is given of the accuracy or completeness of information on these pages. Please be aware that Equal Yoga may alter the information on its website from time to time. Equal Yoga shall have no liability arising from the use by any party of the information on this website. Equal Yoga does not warrant the information on this website in any way & in particular no warranty is given that the website or its contents or hypertext links are virus-free or uncontaminated. 15. PRIVACY & SECURITY POLICY
Your personally identifiable information is kept secure. Only authorised employees, agents & contractors (who have agreed to keep information secure & confidential) have access to this information. All emails & newsletters from our sites allow you to opt out of further mailings. We may use your data to contact you if you have visited the studio as a guest, filled in a web form through our website, emailed us or contacted us on social media. Your opinion is very important to us, so we may send you an email to seek your feedback.
